Officer hurt in accidental shooting sues gun maker

LOS ANGELES—An off-duty Los Angeles police officer who was paralyzed after his young son accidentally shot him in 2006 filed a lawsuit Wednesday against the manufacturer of the gun involved in the accident.
Enrique Chavez of Anaheim was shot in the back by his 3-year-old son after the boy grabbed his father's Glock 21—a .45 caliber semi-automatic pistol—from the back seat of his pickup truck.

The lawsuit, filed in Superior Court, alleges that Glock Inc.'s gun was dangerous because its safety device was "non-existent or ineffective" at preventing an accidental shot.

Chavez, 35, is also suing the manufacturer of the gun's holster and the retail stores that sold him the gun and the holster. He bought the gun at the Los Angeles Police Revolver and Athletic Club and purchased a holster made by Uncle Mike's and Bushnell Outdoor Products from Turner's Outdoorsman.

The lawsuit alleges the defendants knew the safety device was defective and that 5.5 pounds of pressure on the trigger frequently results in accidental discharges.

The lawsuit alleges product liability, breach of warranty and loss of consortium, and seeks general, special and punitive damages, and attorneys fees.

Calls made after business hours to the defendants were not immediately returned Wednesday night.

I would LOVE to see Glock do what Barrett did and stop selling and servicing that department/county/state etc.

i heard that if you try to sue glock they'll hire badass lawyers to squash you. they take that whole "safe action pistol" thing very seriously.

i really don't see how this guy has a chance.

My take is that he needs the money due to his injury and resulting medical bills.

I keep hoping that I'll get in on an injury suit when I get jury notices, I'd like to let the plaintiff know what a dope they are. Seems that idiots are being rewarded more and more these days for being stupid.

this is why people should teach their kids about firearms at an early age. its his fault his kid shot him and he should just accept it.

my friends daughter stabbed me in the leg with a pencil while she was playing. should i sue the pencil company and the pencil sharpener company? :lol:

Too bad the kid didn't aim higher and blow the guy's fuckin' head off, it would've been no great loss to humanity. I have no sympathy for stupidity ... :evil:

This guy left a loaded weapon within reach of a child? At best, that’s a negligent (Not ‘accidental’. Nothing accidental about it.) discharge. More realistically, that's reckless endangerment. Dumbass. :mad:

i'm glad the kid didn't shoot himself. what the hell was a "cop" thinking leaving a gun in reach of a minor. deuche bag.

Right. I feel absolutely no sympathy for this guy whatsoever.

It would be a sad day (in already pathetic times) in America if this guy wins his lawsuit.
